1. Contract
This Contract will be entered into and will become binding upon you when Lee Evans places in the post to you a written booking confirmation.
2. Payment and Advance Booking
A deposit of 25% of the rental fee is payable if the booking is made more than 4 weeks before the commencement of the rental. This acts as a deposit to secure the Cottage. The remaining balance of the rental fee must be made not less than 4 weeks prior to the commencement of the rental. Non-payment of the balance of the rental fee on or before the due date shall be construed as a cancellation of the contract by the customer.
If booking is made 4 weeks or less before the commencement of the rental, the full rental fee is payable on booking.
Payment can only be accepted by cheque if it is denominated in sterling british pounds and received not less than two weeks before the commencement of the rental. All payments shall be made to M L Evans.
3. Cancellations
We respectfully remind customers that a reservation constitutes a contract between themselves and Haulfre Gardens Holiday Cottage. Our cancellation policy is designed to be fair to both parties.
Any cancellation made by the customer for whatever reason shall be in writing. If the booking is cancelled within two weeks of the arrival date, the entire rental fee will be forfeited. For cancellations made prior to two weeks before the arrival date, a percentage of the rental fee will be refundable, the percentage being calculated according to a sliding scale and increasing with the length of time between the date of cancellation and the arrival date. The amount of the cancellation fee as set out below constitutes Lee Evans's reasonable estimate of losses arising out of a cancellation. Lee Evans strongly recommends customers to take out Cancellation Insurance, details of which are set out in paragraph 4.
A deposit of 25% of the booking fee is payable at the time of the booking, the balance being due 4 weeks before the arrival date. The balance will be collected automatically if we hold the customer's credit card details, but if the deposit was paid by some other method, then the customer must remit the balance so that we receive payment by the due date. Should we not receive the balance by the due date (or should the credit card company refuse the payment if the deposit was paid by that method) then we will attempt to contact the customer using the contact details with which we have been supplied, but it nonetheless remains the customers responsibility to ensure the balance is paid on time. If we have still not received the balance 2 weeks after the due date, then the booking will be deemed to have been cancelled, the deposit will be forfeited and we will be free to rebook the property. When a booking is cancelled, the percentage of the booking fee charged as a cancellation fee (i.e. not refunded) will depend upon the amount of time still to elapse before the arrival date as per the following table:
0-2 weeks 100% of booking fee
2-4 weeks 50% of booking fee
4-6 weeks 75% of deposit
6-8 weeks 50% of deposit
8-10 weeks 25% of deposit
10 weeks and over 10% of deposit
In the case of transfers, there is no penalty provided the new booking fee matches or exceeds the price of the old one and the transfer is to an earlier date or a date no later than 8 weeks from the commencement of the original booking.
4. Cancellation Insurance
Cancellation Insurance is not compulsory but we strongly recommend such insurance cover to protect against the cancellation penalty.
5. Number of Persons in the property
The number of persons occupying the property must not exceed the maximum number stipulated in our marketing information or on our website. Lee Evans reserves the right to refuse entry to the entire party if this condition is not observed.
6. Care of the property
The customer shall take all reasonable and proper care of the property and its furniture, pictures, fittings and effects in or on the property and leave them in the same state of repair and in the same clean and tidy condition at the end of the rental period as at the beginning. Smoking is not permitted in the property. The customer undertakes not to do or permit anything on the premises which might cause a nuisance to the owner or neighbours.
7. Breakages or Damage
The customer will be responsible, whether caused directly or indirectly by the customer, for any damage or breakages to the property or its contents. In the event of damage to the property, the customer will on an indemnity basis reimburse Lee Evans the cost of repairing the damage. In the case of breakages, the customer will on an indemnity basis reimburse Lee Evans the cost of replacing (as new) or repairing the damaged item or items.
8. Pets
Well behaved pets are welcome at Haulfre Gardens Holiday Cottage for an additional charge of £5.00 per pet and MUST be booked when making your reservation.
9. Parking
Parking is available for a maximum of 3 vehicles at the property. Vehicles should be parked on the forecourt of Haulfre Gardens Holiday Cottage and not on the access road to the property or in the neighbouring property.
